In the wake of the Supreme Court’s Dobbs decision, the nation has been struck by a wave of “zombie laws” coming back to life with extreme abortion bans.
These are laws passed decades ago (some more than a century) that were rendered invalid by Roe v Wade. But they were never removed from the books, and now they’re back to haunt us all.
A pre-Civil War Texas law from 1857, drafted amid a racist panic over declining white birth rates, has already sprung back from the grave and (coupled with the state’s trigger law passed in 2021) made abortion a felony punishable by up to life in prison.
A Michigan law from 1931 makes abortion a crime in almost every case, including rape and incest, and stands to be reanimated unless Prop 3 passes on the ballot in November. Currently a court order is all that holds this ban at bay.
Altogether nine states – Alabama, Arizona, Arkansas, Michigan, Mississippi, Oklahoma, Texas, West Virginia and Wisconsin – had Pre-Roe abortion bans on the books that stand to be (or already have been) activated by the fall of Roe v Wade.
