Federal Student Loan Forgiveness Update

Dear Constituent, 

The Biden Administration’s visionary action of student debt relief is a vital step forward in our fight to ensure that individuals across America can get a quality education without taking on crushing amounts of debt. More than 2 million borrowers across New York are now eligible for life-changing help. This historic relief will give working individuals more flexibility whether they’re getting ready to start a family or make a down payment on a house. Democrats will continue working to strengthen education at every level, from investing in our public schools to providing high-quality job training and affordable community college.

The Biden Administration is providing up to $10,000 in federal student debt relief and up to $20,000 in relief if you received a Pell Grant. The debt relief applies only to loan balances taken before June 30, 2022. Any new loans disbursed on or after July 1, 2022, are not eligible for this debt relief. You have until December 31, 2022, to apply. This one-time student loan debt relief provided by the U.S. Department of Education (ED) will not be taxed at the federal level. It is important to note that despite recent legal challenges, individuals are still able and encouraged to complete the application.

Find Out Whether You Are Eligible

You may be eligible if: 

-       Did not file taxes and made less than the required income to file federal taxes

-       Single and made under $125,000 per year

-       Married, filed your taxes separately and made less than $125,000 per year

-       Married, filed your taxes jointly and made less than $250,000 per year

-       Head of household and made less than $250,000 per year

-       Qualified widow or widower and made less than $250,000 per year

Recently enrolled Undergraduate Students that were enrolled as an undergraduate student between July 1, 2021, and June 30, 2022, born after January 1, 1998 and are not married are eligible for the same amount of debt relief as everyone else, however, your eligibility is based on one or both of your parents’ income, not your own. 

Private non-federal loans are not eligible for debt relief. See what loans are eligible:

-       William D. Ford Federal Direct Loan (Direct Loan) Program loans

-       Federal Family Education Loan (FEEL) Program loans held by ED or in default at a guaranty agency

-       Federal Perkins Loan Program held by ED

-       Defaulted loans (including ED held or commercially serviced Subsidized Stafford, Unsubsidized Stafford, parent PLUS, graduate PLUS; and Perkins loans held by Education Department. 

-       Consolidation loans as long as all the loans were taken out before June 30, 2022. 

-       Consolidation loans of FEEL or Perkins loans not held by ED are eligible if the borrower applied for consolidation before September 29, 2022.
