NYC Judge Rules Vaccine Mandate for City Employees Unconstitutional After City Fires Nearly 2,000 People
Daily Wire: Unvaccinated New York City workers scored a victory Monday after a New York Supreme Court judge ruled the city’s vaccine mandate for all city employees is arbitrary, capricious, and unconstitutional. New York City Democratic Mayor Eric Adams fired roughly 2,000 municipal workers — including police officers and firefighters — earlier this year who refused to comply with the COVID vaccination mandate. The court found that “being vaccinated does not prevent an individual from contracting or transmitting COVID-19,” adding that vaccinated and unvaccinated individuals have the same quarantine and isolation guidelines issued by the Centers for Disease Control and Prevention ( Daily Wire). NYCforYourself: Judge Strikes Down NYC Vaccine Mandate for City Workers. “It’s null and void,” says attorney @ChadLaveglia. “We just defeated the vaccine mandate for every single city employee” ( Twitter). Raheem Kassam: NY Supreme Court orders reinstatement of fired unvaxxed staff, WITH backpay, says “Being vaccinated does not prevent an individual from contracting or transmitting Covid-19,” adding that the mandates were “about compliance” ( Twitter).

Herschel Walker Takes Back Lead in Polls Over Incumbent Democrat Raphael Warnock
Just the News: Georgia Republican Senate candidate Herschel Walker has reclaimed the lead in his electoral contest with Democratic Sen. Raphael Warnock. Walker initially began to emerge as the frontrunner in the Senate race as early as September, though his polling numbers dipped following the allegation that he previously paid for an abortion, a claim he denies. Walker faced off with Warnock on the debate stage last week, after which polls emerged showing him reclaiming ground in the race ( Just the News). Walker leads Warnock 48.9 percent to 46.5 percent ( Trafalgar).

Poll Shows Democrat Priorities Not Shared by Americans
Life News: Another new poll reflects just how out of touch Joe Biden and Democrat leaders are with the American people. While Americans grow increasingly concerned about inflation, crime and secure borders, Biden and Democrat candidates have been prioritizing abortion on demand leading up to the November election. Abortion came in at number six on the list ( Life News). Newsweek: 46 percent of respondents identified inflation as their priority, followed by issues related to elections and voting (38 percent), crime (37 percent), immigration (34 percent), jobs and unemployment (32 percent), abortion (30 percent), racial inequality (25 percent), gun control (24 percent) and climate change (23 percent) ( Newsweek).

New York Governor Hochul’s Soft Crime Policies Could Be Her Undoing
Washington Free Beacon: New York governor Kathy Hochul (D.) dismissed her state’s crime wave as a few “high-profile instances,” even as crime in New York City spiked 15.2 percent in the last year. Hochul said Monday these few incidents have created “a sense of fear in people’s minds.” Yet the most recent New York City Police Department data show a 22.7 percent increase in burglary and a 21.5 percent increase in grand larceny auto last month compared with a year ago ( Washington Free Beacon). New York Post: Even some Democratic elected officials are starting to grumble about Gov. Kathy Hochul telling voters she worked to change bail laws as Republican challenger Rep. Lee Zeldin breathes down her neck in the final two weeks of the campaign. “When she had the power to really address these things to make New York safe, she didn’t,” one Democratic state senator told The Post ( New York Post).

Lee Zeldin and Kathy Hochul’s Debate Was Largely a Referendum on Her Crime Policies
Townhall: On Tuesday night, Gov. Kathy Hochul (D-NY) met to debate with Rep. Lee Zeldin (R-NY) on the one debate she agreed to, although Zeldin called for several more debates. Rep. Zeldin in his opening statement referenced the rising crime in New York, as has been a campaign focus of his. In her opening statement, Gov. Hochul tied crime to gun control, which she would keep doing this throughout the debate ( Townhall). RNC Research: @leezeldin slams Democrat Kathy Hochul’s pro-criminal policies for wreaking havoc in New York. “We can continue with the status quo where they believe they haven’t passed enough pro-criminal laws” or we can “make sure law-abiding New Yorkers are in charge of our streets again” ( Twitter). GOP Comms Director Jesse Hunt: Why are Dems in trouble in NY Gov? This attitude toward crime and safety. Zeldin: She still hasn’t talked about locking up anyone committing any crimes Hochul: Anyone who commits a crime under our laws…has consequences…I don’t know why that’s so important to you ( Twitter). Townhall: Rep. Lee Zeldin when asked about mandating the COVID vaccine for school children: “Let me be clear to all of the parents who are out there: I will not mandate COVID vaccines for you kids, EVER” ( Twitter). Reuters: Recent public opinion polls show Zeldin is gaining on Hochul, prompting the governor to put new focus on public safety in the final weeks of her campaign. Early voting starts in four days ( Reuters).

Dr. Mehmet Oz and John Fetterman Debate with Nearly Half of Pennsylvania Ballots Submitted
People will want to change their vote to Oz after experiencing Fetterman on live tv. Spencer Brown: On Tuesday night, Mehmet Oz and John Fetterman finally met to debate after the Fetterman campaign tried to avoid debating Oz, then finally folded under immense pressure from all sides of the political spectrum ( Townhall). Wall Street Journal: Remarkably, though, almost half of the mail ballots requested in Pennsylvania have already been cast and returned. As of Tuesday, officials had received 635,428 mail votes out of the 1,310,189 that voters originally requested. That’s 48% ( Wall Street Journal). Townhall: Unbelievably, moments after being read his own quote saying “I don’t support fracking at all,” John Fetterman says “I’ve always supported fracking” ( Twitter). CNN: The comments are part of a long and often contradictory series of positions from the Senate candidate on the industry. Fetterman’s message about the industry has often depended on his audience and he has attempted a balancing act ( CNN). RNC Research: CLOSING STATEMENT from @DrOz: “Ask yourself this and others in your family, are you unhappy with where America’s headed? I am. If you are as well, then I’m the candidate for change” ( Twitter). Hugh Hewitt: Every Democrat on every ballot is mad at John Fetterman tonight for hurting them all. Sometimes the Biden Basement strategy is not just the best way, it’s the only way ( Twitter). Interactive Poll: WPXI Online Poll: Who won the PA Senate Debate? (R) Mehmet Oz 82% (D) John Fetterman 18% ( Twitter).

Southern California School Board Race Gets Contentious After Revelation of Scandalous Sex Ed Curriculum
Conejo Guardian: The Conejo Valley is one of many national hotspots where parents are standing up against child sexualization in public schools. Fathers and mothers in places like Loudon County, Pa., Colorado and Fairfax, Va., are pushing back hard against school boards bent on actively promoting deviant sexualities, self-mutilation via “gender transition” surgeries, and so-called “gender identity” to young children, against the wishes of parents ( Conejo Guardian). Mario Presents: A concerned father reached out to @againstgrms asking for a voice of reason. I have 2 students in the district in my niece and nephew so I answered the call ( Twitter). Matt Walsh: The Democrats have settled on their closing argument: “Vote for us so that we can castrate children, use your money to pay for abortions, and put pornography in the schools. If you don’t vote for us then you are a Nazi and democracy will die.” Fascinating political strategy ( Twitter).

Brittney Griner’s Appeal for More Lenient Sentencing Over Drug Possession Denied
Fox News: A Russian court rejected Brittney Griner’s appeal of her nine-year prison sentence for drug possession on Tuesday. The court ruled to uphold the sentence handed down to the WNBA superstar. However, in the ruling, the court stated that the time Griner will have to serve in prison will be recalculated with her time in pre-trial detention taken into account. One day in pre-trial detention will be counted as 1.5 days in prison, which means Griner will serve around eight years in prison unless the U.S. and Russia come to an agreement on a potential prisoner swap in the future ( Fox News). CNBC: Under Russian law, the charge carried a penalty of up to 10 years in prison. In August, Griner was found guilty and sentenced to nine years. She was also ordered to pay 1 million rubles, approximately $16,301 ( CNBC).
