Misuse of Texas Data Understates Illegal Immigrant Criminality
By Sean Kennedy, Jason Richwine, and Steven A. Camarota, October 11, 2022
Excerpt: Activists and academics have been misusing data from the Texas Department of Public Safety in studies claiming that illegal immigrants have relatively low crime rates. These studies do not appreciate that it can take years for Texas to identify convicts as illegal immigrants while they are in custody. As a result, the studies misclassify as native-born a significant number of offenders who are later identified as illegal immigrants.

‘Root causes’ aren’t behind migrant surge — it’s open borders
By Todd Bensman
New York Post, October 13, 2022
Excerpt: So how’s that root causes nation-building project working out so far? Short answer: About as well as the idea worked for European liberals who first concocted the root-causes doctrine in the early 1980s, resurrected it after the catastrophic mass migration of 2014-2015, and have seen it fail miserably ever since. Border Patrol apprehension numbers, widely regarded as the chief indicator of total crossings, is the ultimate progress report.

CNN Op-Ed Makes Some Good Points About Biden’s Immigration Policies
By Andrew R. Arthur
Excerpt: The author makes several good points but his ultimate recommendation is absurd, and will just make the problems he identified worse. It’s still worth the read, but you can skip the end.
Biden’s DHS Has Made Every City an Illegal Alien Sanctuary
By Jon Feere
Excerpt: Controversial ICE guidelines already drastically limit *which* illegal aliens can be arrested, but this protected-places policy further undermines ICE’s mission by significantly limiting *where* illegal aliens can be arrested. Even the small portion of aliens ICE officers are allowed to arrest under Biden administration priorities are still off limits if they happen to be located in or near a so-called protected place.

Finally, the U.S. Department of Labor Strengthens H-2A Rules
By David North
Excerpt: The Labor Department is publishing new regulations on living conditions for H-2A visa farmworkers. They should, among other things, improve the lives of those workers, make the use of them more expensive, and thus encourage the employment of U.S. workers — that’s the good news. The bad news is the rules only apply to imported visa workers, not U.S. citizens or green card holders, or to illegal aliens.
Prognostication Scorecard
By George Fishman
The 1996 immigration law's intent to bar lower court pre-merits injunctions is at last being honored through the Supreme Court’s long overdue decision in Garland, and its intent not to bar post-merits injunctions is being honored in a de facto fashion, and will continue to be so unless the Supreme Court surprises me in the future and bars lower court vacaturs.
