Last week, the 5th Circuit Court of Appeals ruled that DACA is unlawful — impacting the lives of millions of people across the country and harming communities and the economy.

For DACA recipients who have built their lives in the United States over years — like advocacy leader and DACA recipient, Maria — this ruling could be a disaster. This deeply disappointing decision from the 5th Circuit makes even more clear that without legislation protecting DACA recipients passing this year, we could see nearly 700,000 DACA recipients lose their work authorization, lose critical protection from deportation, and have their lives thrown into chaos in the very near future. This ruling has devastating consequences, in response FWD.us launched the TV ad “Congress Must Protect Dreamers Now” on national cable news.

The 5th Circuit decision does allow renewals for existing DACA recipients to continue. However, as the case continues in the courts, we encourage DACA recipients to renew as soon as possible while those applications are still being accepted, and consult an attorney because renewals could end very soon.

This ruling makes it clear that the 5th Circuit is continuing on the same path we have seen from District Court Judge Hanen — to terminate the DACA program. While we do not know the exact timing of further court action, we do know that the chances of DACA surviving for much longer are significantly worse. And we do not know for how long renewals will stay open and we encourage DACA recipients to consult an attorney. The urgency for Congress to act this year, during the lame duck session, is higher than it has ever been.

The bottom line is that Congress absolutely must act this year or else the consequences will be a disaster. An overwhelming majority of Americans — from both sides of the aisle — support permanent protections for DACA recipients. It’s never been more important for you to tell your Member of Congress, your senators, and President Biden where you stand.
