Dear John,

No one tried harder to overturn the 2020 presidential election than right-wing activist Ginni Thomas, the wife of Supreme Court Justice Clarence Thomas.

Now the Supreme Court is taking up a case that could pave the way for Thomas and Trump to try to steal the White House again in 2024.

Here’s the situation: The core of Ginni Thomas’s argument for overturning the 2020 election was a fringe legal theory called the “independent state legislature doctrine,” which says that state legislatures may throw out the results of a free and fair presidential election and hand their state’s electoral votes to whomever they want.

It’s a bonkers idea, but the Supreme Court just agreed to take it up in a case called Moore v. Harper, which hinges on this debunked interpretation of the U.S. Constitution. You read that correctly: debunked. And Ginni Thomas’s husband, Clarence Thomas, will be one of the justices who will rule on it unless we can mobilize enough grassroots pressure to demand that he recuse himself.

John, I cannot say this more clearly: Clarence Thomas simply should not be trusted to rule impartially on this critically important case.

Ginni Thomas sent dozens of text messages to White House Chief of Staff Mark Meadows in support of Trump’s attempted coup, calling the election “the greatest Heist of our History” and predicting that President Biden and his family would “face military tribunals for sedition.”

She even attended the Stop the Steal rally on January 6, 2021, the event sparked the attack on the U.S. Capitol that left five people dead.

Even by the standards of this Supreme Court's conservative majority, it would be an outrageous conflict of interest for Clarence Thomas to rule on a case that so clearly involves his wife.

However, this Supreme Court has proven that they have little, if any, respect for precedent or the rule of law. As a result, the Supreme Court’s public approval ratings have sunk to historic lows, but they just don’t care.

We must demand that Clarence Thomas recuse himself before the Supreme Court hands down a decision that paves the way for Trump or another candidate to steal the 2024 presidential election.
