The resulting bill was so deficient, that it was passed with a 2020 effective date to give the legislature some chance to try to fix what it could. Much work had to be done on the law throughout 2019, including attempting to address whole paragraphs of ambiguous language. While compliance costs are still likely to be unaffordable by most small, medium, and even some large businesses, the exact economic impact is unknown.

For years, the medical device industry was ravaged by unwise public policy, including a devastating 2.3% excise tax that took effect at the beginning of 2013 as part of ObamaCare. It was included largely as an afterthought with little debate or consideration, as one of a grab bag of taxes, fees and fines used to finance the law’s litany of new spending programs.

Consider that a January 2019 Kaiser Family Foundation survey showed that 71 percent of respondents were in favor of the concept of Medicare for All, but support plummeted to 37 percent once voters learned it would eliminate private health insurance or require higher taxes.

Winegarden’s study is the second in the Breaking Down Barriers to Opportunity which looks for challenges and reforms to boost entrepreneurship. Dr. Winegarden’s policy research explores the connection between macroeconomic policies and economic outcomes, with a focus on fiscal policy, the health care industry, and the energy sector.
