This week the Fifth Circuit Court of Appeals handed down its decision on State of Texas v. USA, ruling that the DACA program is unlawful.

We want to be clear — this is not another long-term legal battle without immediate consequences. This is a step toward the likely end of DACA, which means that nearly 700,000 DACA recipients, their families, and their communities could face a potential crisis. Renewals for existing DACA recipients will continue for now, but it’s clear that the courts will end even this option very soon.

This ruling makes it absolutely clear that the courts will continue down the same path that ends in terminating the DACA program, with a final blow to come imminently as the case progresses. This deeply disappointing decision from the 5th Circuit makes even more clear the fate of DACA in the courts — and without legislation protecting DACA recipients passing this year, we could see nearly 700,000 DACA recipients lose work authorization, lose protection from deportation, and have their lives thrown into chaos in the very near future.

That’s why we’re letting you know now that there is only one path forward. Congress must pass permanent legislative protections for DACA recipients and Dreamers this year. DACA has survived a decade of attacks because of support from people like you, but this is the most severe threat to date. Will you please call your senator today and tell them DACA recipients and Dreamers need permanent protection now? [link removed]

As the case continues in the courts, we encourage DACA recipients to renew as soon as possible while those applications are still being accepted. At this time, no new applications are being processed, and all protections could still be stripped away as the case progresses.

The urgency for Congress to act now, in 2022, is higher than it has ever been. It is important for existing DACA recipients to renew while this ability is still available by the courts.

The bottom line is that Congress absolutely must act right now or else the consequences will be a disaster. Join us in urging Congress to immediately pass legislation that provides permanent legislative protections for DACA recipients and Dreamers this year.
