SB 1419 (Becker) Minor Medical Privacy Bill is signed into law

September 30, 2022 Update: SB 1419 Medical Privacy Bill , introduced by Sen Josh Becker, was signed into law today by Governor Newsom. While SB 1419 on its face is a bill that A Voice for Choice Advocacy would normally support, as it strengthens the privacy of the sharing of medical records, this bill also prohibits representatives of minors, age 12 years and older, from inspecting minors’ patient records that relate to sensitive medical services the minor has consented to without their parent or guardian's consent. These may include medical care related to the prevention or treatment of pregnancy, mental health treatment, drug and alcohol treatment, the treatment or prevention of STDs and/or the treatment of infectious diseases. This bill would force California parents to endure the unnecessary burden/cost of litigation in an attempt to subpoena/obtain their child’s medical records. ( [link removed] [[link removed]] )

A Voice for Choice Advocacy worked hard to try to get this section of the bill removed, or at the very least amended so parents and guardians would be allowed high level access of medical records, especially in an emergency or if the child died. While this amendment request was well received by legislators on both sides of the aisle, Sen Becker and specifically the California Medical Association was not willing to amend the bill in any way. The AVFCA lobbyists and legislative team will continue to work to gain legislator support in 2023, with the goal of getting a bill authored to add the ability for minor's representatives to gain access to these records.

A Voice for Choice Advocacy gave key opposition testimony in committee on this bill and our legislative team worked hard to get legislators to vote against or abstain on this bill, and the Governor to veto the bill. Over the past 7 years, A Voice for Choice Advocacy has established itself as the leading legislative organization lobbying in the California Capitol for your health rights. While A Voice for Choice Advocacy's lobbying activity in the Capitol is important, your positive constituent relationships with your CA State Senator and Assembly Member and their staff are critical to assisting with A Voice for Choice Advocacy's efforts in the Capitol. We thank you for all your activism this year!
