Fighting lawless student loan cancellation to restore separation of powers
On August 24, 2022, President Biden revealed his plans to cancel federal student debt for more than 40 million borrowers.
With a one-time price tag of $500 billion, the plan is astonishing enough. But it’s also flagrantly illegal. The executive branch cannot create a massively expensive program by press release, and without statutory authority or even the basic notice and comment procedure for regulations.
This week, PLF filed the nation’s first lawsuit challenging the unacceptable abuse of executive authority to restore the rule of law and to enforce the Constitution’s separation of powers.

PLF, Sacketts return to Supreme Court backed by more than 350 friends—of the court
On Monday, PLF senior attorney Damien Schiff will argue Sackett v. EPA at the Supreme Court. At issue is the scope of the Environmental Protection Agency’s authority to regulate wetlands under the Clean Water Act.
