Jack, when it comes to cases involving U.S elections, Justice Clarence Thomas has a massive conflict of interest--his wife, Ginni Thomas. Ginni participated in and was a co-conspirator in seditious attempts to overturn election results.

Thomas gets away with having a conflict of interest because Supreme Court judges don’t have to adhere to the Judicial Code of Ethics, which applies to all other federal judges. The code requires recusing “from hearing any case in which personal entanglements could lead a fair-minded member of the public to question impartiality.” Thomas’ unethical behavior further reduces the legitimacy of the Supreme Court by skirting ethical boundaries.

We must maintain pressure on SCOTUS judges like Thomas by demanding they recuse themselves if they have a conflict of interest. The upcoming Moore v. Harper case will determine whether the North Carolina Supreme Court has the power to strike down the legislature’s illegally gerrymandered congressional map for violating the North Carolina Constitution.

This case will influence the checks and balances of our election system. Due to the conflicts of interest involving his wife, Thomas has no business presiding over cases involving elections. Ginni Thomas’ opinions regarding Trump compromise any position he might take in election cases.
