Public Notice: PROPOSED DISCHARGE OF DREDGED OR FILL MATERIAL TO THE CLARKS FORK RIVER
The Wyoming Department of Environmental Quality (WDEQ) has received a request from JL Engineering LLC on behalf of Oliver Joost for State certification of U.S. Army Corps of Engineers (USACE) Nationwide Permits #14 and #45, for discharge of dredged or fill material to the Clarks Fork River near Cody, Wyoming. The purpose of the project is to repair damages to a subsided existing bridge and stabilize eroding banks that resulted from the June 2022 flood. This segment of the Clarks Fork River is designated Class 1 where point source discharges are prohibited except for storm water and construction related discharges. This certification will require meeting the provisions in Chapter 1, Section 7(b) of the WDEQ Water Quality Rules and Regulations, which allows these discharges under certain circumstances.
Proposed activities within the Clarks Fork River include lifting the bridge to original design elevation and repairing the center pier. A toe-wood and fabric soil encapsulated bankfull bench with willow plantings will also be constructed along approximately 400-feet of stream bank to protect residential infrastructure. To do this will require the placement of approximately 3,760 cubic yards of imported fill material in the river. Less than 0.10 acre of wetlands may be impacted.
