We’ve already won THREE monumental cases in front of the Supreme Court of the United States…
…and now we’re trying to make it four.
Today, we filed a certiorari petition at the Supreme Court of the United States in our Brach v. Newsom case.
In case you missed the details of this critical lawsuit, allow me to fill you in.
In 2020, California Governor Gavin Newsom shut down in-person education, both public AND private, for nearly 90% of California’s population while making sure to send his own children to a school that was exempted from the mass closures.
These school lockdowns harmed so many students who needed access to an in-person education…
…and the test scores today are showing it.
Gov. Newsom did NOT have the constitutional authority to order these harmful closures.
So, with your support, we stepped in on behalf of several families and sued Gov. Newsom.
Initially, we won this case at the Ninth Circuit Court of Appeals when the court ruled that Newsom did NOT have the authority to close private or religious schools.
Unfortunately, the Ninth Circuit Court granted Governor Newsom’s en banc petition and an en banc Ninth Circuit dismissed our case and remanded it back to the lower court—erasing our previous win.
Ultimately, the en banc Ninth Circuit held the case was moot because schools are now open.
But you and I both know that Newsom can and will shut down schools again during the next crisis.
That is why he is fighting so hard to win this case…
…he desperately wants to have the power to unilaterally shut down the state, including schools.
You and I cannot allow the next generation to be irreparably harmed by the tyrannical behavior of Newsom and others.
That’s why we’re petitioning the Supreme Court to hear this case.
Because we must make sure nothing like this can ever happen again.
If Newsom and radical leftists like him get their way, they’ll be able to start and stop education and other public services whenever they see fit.
