Big news in Virginia: this Friday, the 13 youth plaintiffs in Layla H. v. Commonwealth of Virginia will have their first hearing in Richmond!
 
At 11:00am EDT on September 16th, attorneys from Our Children’s Trust and local counsel will argue before Honorable Clarence N. Jenkins Jr. that the constitutional claims of these young climate leaders should proceed to trial.
 
If you’re in Richmond, you can attend the hearing in-person this Friday, September 16th at 11am EDT at Richmond City Circuit Court!

Then, after the hearing, the youth and their attorneys will host an in-person press conference outside the courthouse where people can hear from the attorneys and young plaintiffs about what happened in court and what will happen next in their landmark Virginia climate case.

Attend the In-person Hearing in Richmond
If you live in or near Richmond, VA, please plan to attend this important hearing on Friday, September 16th. Seating is very limited so please arrive at Richmond City Circuit Court before the hearing begins at 11:00am EDT to secure a seat. Please note that cell phones are not allowed in the courtroom and all attendees must adhere to court rules and regulations, including no talking, signs, or other disruptions.

After the hearing, at 1:00pm EDT, the youth plaintiffs and their attorneys will host a brief press conference outside the courthouse. If you’re able to attend the hearing, please stay for the press conference too! And if you’re not local to Richmond, you can watch the press conference via livestream on our Facebook page here.
 
Stand in solidarity with these young climate leaders, either in-person in Richmond or online from around the world, by tuning into this press conference after the hearing. You’ll hear directly from some of the plaintiffs as well as learn more about what you can do to support these young Virginians as they seek to secure constitutional protection of their right to a safe climate!

All About Layla H. v. Commonwealth of Virginia
Filed in February 2022, this case argues that the Commonwealth of Virginia’s historic and ongoing permitting of fossil fuels is causing and contributing to the climate crisis, and violating the young plaintiffs’ constitutional rights. The youth plaintiffs assert that Virginia has violated its public trust duty to protect elements of the public domain, including atmosphere, required to preserve constitutional rights. They also assert that the Commonwealth of Virginia continues to rely primarily on fossil fuels as its main energy source and is thereby exacerbating climate change by polluting the atmosphere with dangerous greenhouse gas emissions.
