Topic:?Adoption (CR-103) - Protecting Temporary Workers
Brief Description:?The purpose of this rulemaking is to create chapter 296-801 WAC, Protecting Temporary Workers, to implement requirements from Substitute House Bill 1206 (SHB 1206), passed by the Washington state legislature in 2021, codified as RCW 49.17.490. RCW 49.17.490 requires staffing agencies to assess the employer?s safety and health practices at the workplace that the employee will be working. They must assess the safety conditions, the tasks the employee will be completing, as well as the safety program that the employer has in place. These inquiries are required to take place at the start of the contract, and it may involve the staffing agency visiting the actual work site. The adopted rulemaking incorporates the statutory language passed by the legislature and includes requirements for staffing agencies and worksite employers.

Topic:?Longshore and Waterfront Operations & Restrooms in Ports and Railyards
Brief Description:?The purpose of this rulemaking is to initiate rulemaking in chapter 296-56 WAC, Safety standards-longshore, stevedore and waterfront related operations. This rulemaking will align the standard with Substitute House Bill 1706 (RCW 70.54.480), passed by the legislature in 2022, regarding drayage truck operators access to restrooms when operating in or on a port or rail yard property. New requirements include access to restrooms and dedicated space for lactation. This rulemaking will also better align chapter 296-56 WAC with the Federal Occupational Safety and Health Administration (OSHA) requirements for marine terminals in 29 CFR 1917, Subpart A. This rulemaking may also include housekeeping and formatting updates.?
