With the stroke of a pen, the Biden administration is destroying Title IX by unlawfully rewriting the language by redefining ‘sex’ to mean ‘gender’ and ‘gender identity.’

The administration’s proposed Title IX regulations will open up previously female spaces, including women’s sports, to any male who identifies as a woman; expand the definition of sexual harassment to include ‘offensive’ speech; eliminate due process protections for those accused of sexual harassment; and subvert the rights of parents.

This is wrong, and it isn’t fair.

The Supreme Court recently held that executive agencies may not adopt regulations that go beyond the scope of the statute as written. The administration has overreached by attempting to expand the categories of people protected by Title IX beyond those designated by Congress.
