The U.S. Supreme Court won’t protect abortion. Congress won’t protect abortion. State legislatures that could protect abortion are not always in session.

It’s time for statewide elected officials to step up and assert their authority to prevent further criminalization of abortion, particularly self-managed abortion.

Self-managed abortion is not shameful or something we should shy away from talking about. Abortion can be safely self-managed with pills up to 12 weeks of pregnancy, and multiple organizations exist as resources for people who choose this method.

Legal protections for people who self-manage abortion are murky. Even though self-managed abortion is not explicitly illegal in most states, investigations, arrests, and prosecutions still happen, predominantly targeting Black, brown, and low-income people.

Unsurprisingly, after Roe v. Wade was overturned, police, politicians, and other anti-abortion extremists have only deepened their campaign to criminalize self-managed care.

State attorneys general wield considerable power—and this is where they can make a real difference. There are multiple steps AGs can take to shield their constituents from abortion bans and criminalization—including prohibiting law enforcement resources from being used to prosecute self-managed abortion care and urging district attorneys to issue nonprosecution policies.

Anti-abortion politicians have used every sneaky trick in their playbook to lead us to the abortion access crisis we’re facing now. We’d be downright foolish—and negligent—to not use the tools at our disposal to fight back.
