AFL ASKS FIFTH CIRCUIT COURT OF APPEALS TO STOP BIDEN ADMINISTRATION’S UNCONSTITUTIONAL, UNLAWFUL, AND DRACONIAN FEDERAL EMPLOYEE VACCINE MANDATE
WASHINGTON, D.C. – Today, America First Legal (AFL) filed a brief in the United States Court of Appeals for the Fifth Circuit supporting thousands of federal civilian workers who are battling the Biden Administration’s patently unconstitutional, irrational, and unscientific COVID-19 vaccine mandate.The increasingly oppressive tactics of the Biden Administration to wield power know no bounds, and AFL continues to fight on behalf of all Americans to preserve the rule of law and uphold the Constitution.
AFL has been at the forefront, relentlessly challenging the Biden Administration’s unconstitutional and obsessive determination to violate the rights and liberties of federal employees, as well as those of other American citizens. This is the fourth brief AFL has filed on behalf of workers to challenge the Biden Administration’s illegal mandate:
- AFL opposed the Administration’s motion to stay after the federal district court found the Administration’s mandate that federal workers undergo medical treatment was unlawful, unconstitutional, and “a bridge too far;”
- When the Fifth Circuit heard the case on appeal, AFL filed a brief in support of the federal workers.
- After a three judge panel issued an adverse and mistaken opinion, AFL filed a brief in support of the request to have the entire Fifth Circuit reconsider the case.
- Now, AFL is urging the Fifth Circuit to confirm what is plainly clear: Biden’s mandate is neither supported by the law nor by the U.S. Constitution.
Separately, AFL has also been fighting Biden’s immense executive overreach on behalf of two other workers who have bravely taken on the Administration:
- In Payne v. Biden, AFL is representing a long-time Department of Navy civilian worker. His case is currently on appeal to the U.S. Court of Appeals for the District of Columbia Circuit.
- In Vierbuchen v. Biden, AFL is representing a Department of Justice criminal prosecutor. The judge in this case has paused it pending a final decision in the Feds for Medical Freedom case in the Fifth Circuit.
Time and again, the Biden Administration has demonstrated absolute contempt for our citizens’ rights, the rule of law, and the United States Constitution. Contrary to law, Biden has opened the border, turned the FBI loose against American parents, openly colluded with Big Tech to control information and suppress dissent, and mandated unnecessary vaccinations. No American should be forced or coerced into taking the COVID-19 vaccine to keep their job. AFL will keep fighting on this and all other fronts to protect our Constitution and uphold the rule of law.
