Big Tech has a choice to make after the Supreme Court’s decision to overturn Roe v. Wade. Companies can protect their users’ privacy, or they can open the floodgates to give police access to personal messages that can be used to criminalize people seeking abortion care.

Facebook has already chosen the latter—with dire consequences.

In August, news broke that Facebook handed over private messages to Nebraska cops after being served with a warrant during a police investigation into a 17-year-old suspected of acquiring abortion pills. Police used the messages as evidence that she had a self-managed abortion.

The teen, now 18, is facing criminal charges and is being tried as an adult—even though the alleged abortion would have occurred before Roe was overturned. The teen’s mother and a third individual also face charges.

Facebook messages are not automatically encrypted, unlike messaging platforms like Signal or WhatsApp, which use end-to-end encryption and couldn’t give chat history to police even with a warrant.

All Big Tech platforms with messaging capabilities, including Facebook, must implement end-to-end encryption immediately so they are not complacent and compliant in the ever-worsening criminalization of abortion.
