Brief Description:?The purpose of this continuance is to provide another public hearing for rulemaking amending Unified Safety Standards for Fall Protection?(see?WSR 22-14-097). The original virtual public hearing meeting link posted on the L&I website was faulty and did not allow the hearing to occur as scheduled. In order to ensure ample time for public comment, the comment period is extended to August 30. In-person hearings have already been held in Tukwila on August 9, 2022, and Spokane on August 11, 2022.
The purpose of this rulemaking is to amend chapter 296-880 WAC, Unified safety standards for fall protection. In August 2021, the Division of Occupational Safety and Health (DOSH) received notification from the Federal Occupational Safety and Health Administration (OSHA) relating to DOSH?s fall protection standard. The notification advised L&I that DOSH needed to amend the fall protection rules in order to be at least as effective as those administered by OSHA, as required by the Washington State Plan. This rulemaking proposes changes to sections of the current fall protection rule that address roofing activities including leading edge work, work performed on a low or flat pitch roof, and ski area facility and operations.

Brief Description:?This emergency rule allows the Factory Assembled Structure (FAS) Program to effectively approve plans for commercial coach trailers, factory-built housing and commercial structures, recreational park trailers, recreational vehicles, and conversion vendor units (food trucks and trailers) as required under RCWs 43.22.360 and 43.22.480. The rule language includes changes to chapters 296-150C and 296-150F WAC that clarify plan submission requirements. The rule adds provisions to chapters 296-150P, 296-150R, and 296-150V WAC to allow plans for recreational park trailers, recreational vehicles, and conversion vendor units to be reviewed and approved by a licensed professional engineer, architect or firm as authorized by RCW 43.22.360(3).
This rulemaking renews the emergency rule filed on April 19, 2022 (WSR 22-09-063), to allow the FAS Program to continue addressing a backlog of more than 900 design plans that still exists, while permanent rules are being developed.
This emergency rulemaking amended the following:

Brief Description:?The purpose of this rulemaking is to consider amendments to the FAS rules for design plan reviews by licensed professional engineers, architects, and firms for commercial coach trailers, factory-built housing and commercial structures, recreational park trailers, recreational vehicles, and conversion vendor units (food trucks and trailers). L&I adopted emergency rules to clarify the procedures for review and approval of design plans for commercial coaches and factory-built and commercial structures by licensed professional engineers, architects, or firms under chapters 296-150C and 296-150F WAC. The emergency rule also allows those professionals to review and approve design plans for conversion vendor units, recreational vehicles (RV), and park model RV?s under chapters 296-150P, 296-150R, and 296-150V WAC. This rulemaking considers the adoption of permanent rules. L&I will be soliciting input from stakeholders in development of the permanent rules.
