While broader gun violence prevention measures are actively debated in Congress, there is one law they could repeal right now that would help ensure that gun manufacturers aren’t free from any responsibility in the wake of shootings.

The Protection of Lawful Commerce in Arms Act has been an unjust shield for gun manufacturers and dealers since it was signed into law in 2005. The law, which prevents gun manufacturers from being sued by victims in shooting tragedies, protects their profits as they continue making products intended for war, not the streets of our towns and cities.

Most manufacturing industries are understandably held accountable when their product results in death – not so for gun manufacturers. By hiding behind federal and state immunity protections, gun manufacturers continue to create and sell their products – free from any legal liability when they're used to cause harm or death to one or more people.

The law does provide for some exceptions to gun manufacturer immunity, but a patchwork of legal cases has demonstrated that challenging the law is extremely difficult – while victims and families of gun violence are forced to deal with the consequences of the bloodshed.

With the legal protections offered in the PLCCA, gun manufacturers and dealers have little incentive to create and implement protection measures that could improve gun safety. We can and must expect more from gun manufacturers – and demand that Congress take this important step to hold them accountable.
