With the 2020 elections fast approaching, millions of Americans face a very real threat that their vote will not be properly counted, whether as a result of defective technology or willful human interference.

Take voters in Pennsylvania, for example. Pennsylvania officials have allowed counties to use ES&S ExpressVote XL voting machines, which have a number of problems including vulnerability to tampering, poor accessibility, and now a history of losing or misrecording votes. In Northampton County [ [link removed] ]'s 2019 elections, glitch-prone touch screens led to frustration among voters and an initial readout that was "near statistically impossible" in one race, causing poll workers to work through the night to correct the mistake.

Together with the National Election Defense Coalition (NEDC), the Pennsylvania-based Citizens for Better Elections (CBE), and individual Pennsylvania voters, Free Speech For People is fighting to ensure that every Pennsylvanian's vote counts. Yesterday, with our pro bono partner law firm Baker Hostetler as co-counsel, we filed a lawsuit against Pennsylvania Secretary of the Commonwealth Kathy Boockvar alleging that the state's use of the ExpressVote XL voting machines violates the state's Election Code and the Pennsylvania Constitution. We are committed to free and fair elections with secure, verifiable, and reliable voting technology for every American.

Pennsylvania is considered a swing state. There is little doubt that it will play a critical role in the 2020 elections, and it may again be one of the states which decide the Electoral College. The only way to ensure that Pennsylvania's results accurately reflect the will of its people is to guarantee secure election technology and a voter-verified paper ballot.

Every American has the right to a counted vote. *By employing ES&S ExpressVote XL voting machines, Pennsylvania places its voters at risk. **Tell Governor Wolf and Secretary Boockvar the ExpressVote XL machines must be decertified before the April 2020 primary.* [ [link removed] ]
