It’s a fringe, dangerous right-wing legal theory that, if blessed by the Supreme Court, would give GOP-controlled legislatures the power to:

Gerrymander maps in order to guarantee unearned Republican majorities

Suppress the vote without being held accountable

Refuse to certify election results in presidential elections

Until recently, independent state legislature theory was considered a fringe idea. But now, the Supreme Court has agreed to hear a case built around it – and experts are sounding the alarm:

MSNBC: It is not an overstatement to say that this case could completely upend elections and erase the power of our votes for president. | Washington Post: [T]he court’s endorsement of [independent state legislature theory] would … create disarray and would enable anti-democratic power grabs. | New York Times: Under the independent state legislature doctrine, the next time Trump tries to overturn the results of an election he lost, he won’t need a mob.

From gutting the Voting Rights Act to enabling gerrymandering and stripping away reproductive freedom, the Supreme Court has made a number of absurd decisions lately — so there’s good reason to be worried about how it’ll rule in this case.

But while we don’t know for sure what the Court will do in this case, we do know this: Electing pro-democracy Democrats at the state and local level is our last line of defense.
