On Monday night, we learned that the FBI executed a search warrant at Mar-a-Lago, reportedly in connection with documents—including classified ones—that Donald Trump took with him from the White House.
This is a big deal.
Back in February—exactly six months before this search—CREW called for the Department of Justice to investigate Trump’s likely criminal mishandling of White House records. At the end of the Trump administration, we filed a lawsuit to attempt to block the destruction of White House records. And now, finally, it appears that a criminal investigation is indeed underway.
Of course, this is not the only conduct for which Donald Trump may be facing criminal investigation. Just recently we learned that federal prosecutors have apparently asked grand jury witnesses about Trump’s actions in connection with efforts to illegally overturn the 2020 election—one of the first signs that the DOJ may be targeting Trump directly in that investigation; we don’t know yet if the federal investigation into Trump’s records is connected with the January 6 investigation. And then there’s the special grand jury in Fulton County, Georgia investigating Trump’s and his allies’ efforts to overturn the 2020 election results in that state. These investigations are crucial to protecting our democracy—and to making it clear that no one, not even a former president, is above the law.
At CREW, we’ve been pushing for criminal investigations of Trump for years. We first called for an investigation into his firing of James Comey—which looked a whole lot like criminal obstruction of justice to us—in May 2017. This year, we released our tracker of Trump’s likely criminal misconduct—cataloging nearly 50 crimes that he appears to have committed while campaigning for or serving as president. Only real accountability for these crimes can restore Americans’ faith in democracy and prevent the same people from committing the same abuses again in coming years.
Of course, CREW can’t carry out a criminal investigation or indict a president. But we can shine a spotlight, expose new facts, and increase the pressure for action.
