The Supreme Court’s highly consequential 6-3 decision in West Virginia v. EPA repudiated the Environmental Protection Agency’s claim that Congress gave the agency sweeping powers to create and pursue its own regulatory agenda to force energy companies’ adoption of alternative energy sources.

It should not have been a controversial decision, write Luke Wake and Daniel Ortner. But it was, at least to progressive-minded law professors and interest groups that hold a competing vision of the Constitution.
