On August 2, the U.S. Department of Justice (DOJ) sued Idaho over its abortion ban, which is set to go into effect on August 25.
As in all states with total or near-total bans, Idaho’s law criminalizes doctors for performing life-saving procedures. That conflicts with a federal requirement to provide medical care when the pregnant person’s life is at stake.
Suing Idaho is a good first step, but the Justice Department must do more.

This is the first lawsuit of its kind the DOJ has filed since Roe v. Wade was overturned in June, but it shouldn’t be the last. Abortion is banned with no exceptions in multiple states, and others have a near-total ban like Idaho’s.
When federal and state law is in conflict, federal law prevails. The DOJ must use its power to challenge all state bans that violate federal law.
If banning abortion is no longer unconstitutional, it is imperative that we use every method at our disposal to restore abortion access. From the grassroots level, to state legislatures, to the Oval Office, we all have a part to play—and this is the DOJ’s.
