Dear Friend,

The last month has been difficult, there’s no denying that. Not only did the Supreme Court continue its attack on our fundamental rights and public health safeguards, it looks like hope for transformative climate investments from Congress has faded. Despair and frustration are fundamentally human responses to these attacks and failures, but we have to keep up the fight. We must continue pulling every lever available to us, because every bit of carbon we keep out of the atmosphere, every bit of pollution we keep out of our bodies, and every bit of habitat we preserve gives us a better chance of persevering in our fight for healthy people and a healthy planet.

With help from Earthjustice supporters like you, we’re laying the groundwork to win those fights. Here’s what we’ve been up to recently:

*We sued the Postal Service for its disastrous plan to buy gas-guzzling trucks, and, with help from your actions, embarrassed the agency enough that it opened a new comment period to hopefully clean up its mess.
*We sued the EPA to compel it to clean up coal ash dumps that continue to poison our water supply.
*We fought Trump’s rollback of the Clean Water Act and encouraged the EPA to take comments on how to restore and strengthen protections.
*We won our lawsuit against the Trump administration’s rollback of the Endangered Species Act, leaving a clear path for the US Fish and Wildlife Service to strengthen the implementation of the law.

Earthjustice’s legal work is essential, but the truth is that it takes public engagement from people like you to secure the protections we need. Too many times, we’ve gone to court and won, only for government agencies to delay, water down, or ignore the work they’re legally required to do. The antidote to this is you — when an agency sees that everyday people are following its work, it knows that there will be consequences if it fails to act.

The events of the last month increased the importance of the comment periods we’re asking you to participate in. Because President Biden has authority to act without Congress, they represent our best hope for action to confront the crises we face. We need everyone to use their voice to urge President Biden to do everything within his power to create change.

Another comment period to push for a 100% electric Postal Service fleet

Your letters to the Postal Service continue to make a difference. The Postal Service just announced it will make at least 40% of its next truck purchases electric. This is a huge win: when we started pushing for electrification in September of 2021, the Postal Service only planned on electrifying 5% of its next purchase. However, 40% is not 100%, and the Postal Service’s comment period for their Supplemental Environmental Impact Statement is still ongoing, so we need to make our voices heard that we need 100%.

Tell the EPA to protect us from legacy coal ash dumps

People living near toxic coal ash dumps across the U.S. are threatened with water poisoned by arsenic, lead, radium, and other heavy metals. Loopholes in the EPA’s rules let polluters at more than 500 coal ash waste sites around the US off the hook for cleaning up the toxic mess they’ve created. Tell the EPA to close these dangerous loopholes and require cleanup at all the nation’s leaking coal ash dumps!

Support the EPA's efforts to restore clean water protections

One Supreme Court decision you might not have heard about came a few months ago, when the Court overstepped to reinstate a Trump administration rule that threatens our water quality. Fortunately, the Environmental Protection Agency is taking steps to put those protections back in place and restore state and Tribal authority to protect their waterways and wetlands. Tell the EPA to work as quickly as possible to restore our clean water protections.

Help protect Boundary Waters from industrial mining

The Boundary Waters area in Minnesota remains at risk of being permanently ruined by a dangerous copper mining project. Although the Biden administration recently threw out the mine’s illegal permits, we need your support to protect this irreplaceable landscape and ban mining next to the Boundary Waters for the long term.
