It has been a monumental week – one that brings hope about the future of our democracy and rule of law.
Friday, the DC Office of Disciplinary Counsel charged former DOJ attorney Jeffrey Clark with ethics violations. Mr. Clark’s efforts to overturn the 2020 election were detailed in an ethics complaint filed by LDAD and signed by a coalition of former DOJ officials, past bar association presidents, distinguished legal scholars, and practitioners.
We're proud to have worked with this prestigious group of lawyers in bringing to light actions by Mr. Clark that had no basis in law or fact.
On Thursday, The January 6 Committee held another riveting public hearing revealing the former president’s shocking refusal to intervene in the insurrection, even as police were under attack and brutally beaten. As commentator Robert Hubbell noted: “The Committee has forever changed the perception of January 6th and has authored the definitive record of this tragic chapter in our history.”
LDAD will continue to speak out about both the insurrection and ongoing efforts to undermine the rule of law also taking place at the state level.
For example, our latest blog post addresses the menacing letter sent by the Texas Freedom Caucus to the global law firm of Sidley Austin regarding its commitment to support employees needing abortion-related services. Threats by state legislators against a law firm for its personnel policies is an attack on the entire profession. We must not stay silent.
The prodigious writings by our colleague, Dennis Aftergut, continue to amaze. He and former ambassador Norm Eisen wrote in CNN about the significance of Steven Bannon’s conviction for defying a subpoena from the January 6 Committee. His recent piece in the Atlantic — co-authored with distinguished attorneys Don Ayer and Stuart Gerson — offers a meticulous rationale for why the former president must be prosecuted, and his co-authored article with former LDAD colleague, Eugene Fidell, in the xxxxxx, addresses the former president’s extraordinary dereliction of duty.
The inflection point for the legal profession to speak out and act is here. The evidence has been amassed, and now the threats to the rule of law are at the profession’s door. This is not about politics; it is about the right of our children to live in a functioning democracy.
