A recent FiveThirtyEight article explains “What It Would Mean For Elections If The Supreme Court Embraces An Extreme Legal Theory.” They’re talking, of course, about the GOP’s independent state legislature theory, which is the foundation of a case SCOTUS has agreed to hear next term.
“The independent state legislature theory is fewer than 25 years old, and for most of its life, it’s been relegated to the fringes of academia.
But it was widely promoted by former President Donald Trump and his allies as they attempted to first undermine – and then overturn – the outcome of the 2020 presidential election.”
Scary. But it gets worse. If the Supreme Court’s conservative majority gives credence to this theory:
Partisan gerrymandering could get much more extreme.
Our system of federal elections would be turned on its head.
State legislators could potentially reject the election results they don't like!
