After a month of January 6th hearings, one thing is crystal clear: Donald Trump likely engaged in criminal conduct including a seditious conspiracy while seeking to overturn the 2020 election.
Testimony from multiple witnesses has made it clear that Trump knew what he was doing when he called for a rally on January 6th. He knew his supporters were armed. He knew what would likely happen when he called for them to march to the Capitol. And he did it all anyway because he had exhausted all legal avenues to challenge the election, but he wanted to remain in power. So he attempted to do it via a violent mob.
The evidence is also clear that Donald Trump knew he lost the election and knew that the schemes he and his allies came up with to overturn the election, from ginning up fake electors to pressuring Mike Pence to reject election results, violated the law. But he pressed forward anyway.
That’s why we’re calling on the January 6th Committee to send a criminal referral about Trump’s actions to the Department of Justice. The committee cannot charge Trump, but they can issue a formal referral to the DOJ about what they’ve found.

Members of the Committee have indicated that issuing a criminal referral could be on the table. As the hearings have unfolded, it has become clear that Trump knew what he was doing—he was warned by his lawyers and closest advisors, he was told that his actions could have grave consequences, and he did it anyway.
Trump poses an existential threat to our democracy. Charging a former president isn’t without consequences—but letting Trump get away with his apparent crimes would be far worse for our country and the integrity of our democracy.
