Independent state legislature theory used to be a fringe idea. But now, the Trump Supreme Court has agreed to hear a case advancing this theory – and experts are sounding the alarm:

MSNBC: It is not an overstatement to say that this case could completely upend elections and erase the power of our votes for president. | Washington Post: [T]he court’s endorsement of [independent state legislature theory] would … create disarray and would enable anti-democratic power grabs. | New York Times: Under the independent state legislature doctrine, the next time Trump tries to overturn the results of an election he lost, he won’t need a mob.

Given recent Supreme Court decisions gutting the Voting Rights Act, enabling gerrymandering, and stripping away reproductive freedom, we have good reason to be worried about how it’ll rule in this case. But while we don’t know what SCOTUS will do, we do know this: Electing Democrats at the state and local level will be our democracy’s last line of defense.
