He is not eligible for an appeal bond due to the excessive sentence he was given. He is stuck serving day-for-day until his appeal comes through. | The District Attorney wrongfully charged Ben with murder, which kicked-off a years-long prosecution that became riddled with ethical lapses, prosecutorial misconduct, errant rulings and politics. Officer Darby's jury was prevented from hearing relevant testimony from witnesses that would have exonerated him. Ben and his wife, Keelin Darby, are now in the fight of their lives to appeal this ruling and request a fair shot at justice.
