In light of the Supreme Court’s anti-environment decision in West Virginia v. EPA, our board has EXTENDED our $2:$1 match for all donations until midnight tonight, July 15. Please click here to donate, then read why below.

Friend, we have a critical update on the Supreme Court.

First: The extreme conservatives on the Supreme Court ruled 6-3 to limit the EPA’s ability to regulate greenhouse gas emissions. They banned the EPA from mandating a shift to clean energy.

Then: We sprang into action.

We’re advocating for the EPA to introduce the strictest regulations that are still allowed.
We’re fighting for transformational climate legislation in Congress.
We’re hiring more attorneys who will use every legal tool available to hold industry accountable, address the climate crisis, and ensure a livable future.

And now: Our board knows the stakes are too high to leave anything on the table. So they extended their $2:$1 match for all donations until midnight tonight.

Friend, we know it can be daunting when the Supreme Court rules against us. But we’ve been preparing for this moment, and we have a strategy that we believe in.

We have won victories for the environment at the Supreme Court before, including a landmark clean water victory in a case argued by Earthjustice attorney David Henkin in front of a conservative majority in 2019. We know we can still win even with the odds against us, whether we’re defending our right to drink clean water, breathe clean air, or live on a habitable planet.

This decision doesn’t change anything when it comes to Congress. We are still fighting every day for our elected officials to pass a budget package that includes bold investments in climate and environmental justice. And let’s be honest: That has always been key to stopping the climate crisis.

Finally, this decision bans the EPA from mandating shifts from one energy source to another, but it does not ban the EPA from regulating the emissions of individual power plants. We will continue to advocate and litigate for the strictest regulations on all coal and gas power plants. Why? When we enforce regulations and make industry pay the true cost for their pollution, it protects overburdened communities, improves public health, and spurs a shift to cheaper and cleaner energy sources. We are not slowing down on that front.

Friend, we won’t sugarcoat it. This decision is a serious blow. But it’s not a knock-out punch. We’re still fighting, and we will never rest. But we rely on grassroots support.
