Louisiana Judge Blocks State’s Trigger Ban and Temporarily Reinstates Abortion

HotAir: Baton Rouge District Judge Donald Johnson ruled on Tuesday that abortion is legal in Louisiana. The ruling blocks the state’s trigger ban, at least temporarily. Judge Johnson’s temporary restraining order was granted to the Center for Reproductive Rights (CRR). A hearing on the case is set for July 18. Like other states that passed trigger bans to go into effect if the Supreme Court overturned Roe v Wade in its ruling in Dobbs v Jackson Women’s Health, Louisiana has been in legal limbo. This is how the near future will look for states trying to restrict abortion access – lawsuits and restraining orders. It means that abortions may or may not be available in pro-life states, depending on which restraining order or judge’s ruling is in effect. In Louisiana, CRR and Boies Schiller Flexner LLP filed suit against the state trigger ban set to go into effect immediately after the Supreme Court overturned Roe v Wade. The two organizations requested emergency relief to allow abortion providers to continue to provide their services. A judge temporarily blocked the trigger ban but that order was lifted when the lawsuit was moved to a different court. Judge Johnson’s ruling on Tuesday puts a temporary restraining order back in place (HotAir). AG Jeff Landry: To have the judiciary create a legal circus is disappointing and what discredits the institutions we rely upon for a stable society (Twitter). New York Times: Louisiana’s State Constitution is unusual in that it explicitly says it does not provide a right to an abortion, meaning the Legislature has the right to pass laws restricting it. But abortion providers in the state argue that the trigger laws violate due process provisions in the Constitution and are “void for vagueness” because they do not provide specifics about what is legal or not under the law (New York Times).

CPI Rose to 40-Year High at 9.1 Percent

Wall Street Journal: The consumer-price index rose 9.1% in the 12 months ended in June, the fastest pace since November 1981, the Labor Department said on Wednesday. The June increase also eclipsed May’s 8.6% rate, which led Federal Reserve officials to shift to a faster pace of benchmark interest-rate increases in its campaign to bring down inflation. The report likely keeps the Fed on track to raise its benchmark interest rate by 0.75 percentage point at its meeting later this month. Stocks dropped and bond yields jumped following the inflation report (Wall Street Journal). Washington Post Economic Columnist Heather Long: Inflation continues to hit hard. Groceries: up 12% in past year –>Biggest annual increase since 1979. Chicken: Up 19% in past year–>Biggest increase ever. Gas up 60%–>Biggest since 1981. Electricity: Up 14% –>Biggest since 2006. Rent: Up 5.8% –>Biggest since 1986 (Twitter). Ed Morrissey: Food inflation is almost entirely in double digits for year-on-year CPI. It’s amazing what consumers are now facing at the grocery store: Cereals and bakery products: 13.8%. Meat, poultry, fish, eggs: 11.7%. Dairy products: 13.5%. Nonalcoholic beverages and related products: 11.9%. Coffee: 15.8%. Carbonated drinks: 11.0%. Other food at home: 14.4% (HotAir). Tom Elliot: Biden Admin Senior Gaslighter @BrianDeeseNEC on the worst inflation in 100 years: “More urgency than ever to pass” new spending bills (Twitter).

Immigration Officials Pushing to Provide Abortions for Detained Migrants

Wall Street Journal: Top immigration officials are planning to instruct detention centers around the country that women in custody are entitled to abortions and should be transferred to receive one if they are being detained in a state where abortion is now illegal. The directive is contained in an undated memorandum, seen by The Wall Street Journal, which cites the recent Supreme Court decision that ended the federal right to an abortion. The memo is from U.S. Immigration and Customs Enforcement Acting Director Tae Johnson and is addressed to Corey Price, head of the agency’s enforcement division. “This memorandum serves as a reminder of existing ICE policies and standards requiring that pregnant individuals detained in ICE immigration custody have access to full reproductive health care,” the memo states. “This is also a reminder that, pursuant to existing ICE policy, it may be necessary to transfer a detained pregnant individual within an area of responsibility (AOR) or to another AOR, when appropriate and practicable, in order to ensure such access.” ICE facilitates abortions for immigrants in its custody in cases of rape or incest, or when the life of the mother is threatened, according to ICE’s health regulations (Wall Street Journal). Daily Wire: The change is also an action to address trigger laws and new restrictions added in several conservative-led states following the overturn of Roe v. Wade in June. The new ICE policy would take precedence in states with laws that strongly limit abortion, allowing abortions in states where they would otherwise be illegal. It is unclear how many women the new policy could impact. Though the number of migrants crossing the nation’s southern border has surged during the Biden administration, the number of women in detention who would seek an abortion while detained is unknown (Daily Wire).

Illegal Immigrant in Ohio Arrested, Confessed to Raping 10-Year-Old Girl

The skeptical story panned out and, in the end, a monster is taken off the street. Fox News: The man charged with the rape of a 10-year-old girl in Ohio is a Guatemalan illegal immigrant, an Immigration and Customs Enforcement (ICE) source told Fox News Digital on Wednesday. The Columbus Dispatch first reported that Gerson Fuentes was arrested after police said he confessed to raping a child on multiple occasions. He has been charged with rape, and the outlet reported that he was possibly in the country illegally. The source told Fox that Fuentes is a Guatemalan national in the country illegally and that ICE has placed a detainer on Fuentes, which is a request he eventually be handed over to the agency for removal proceedings. ICE later confirmed to Fox News Digital that Fuentes is in the U.S. unlawfully (Fox News). Columbus Dispatch: Ohio AG Dave Yost cast doubt on 10-year-old rape victim case, now ‘rejoices” at arrest. Franklin County Municipal Court Judge Cynthia Ebner said the case did not warrant Fuentes — who is believed to be undocumented — to be held without bond. Ebner said a high bond was necessary, however, due to Fuentes being a possible flight risk and for the safety of the child involved. Ebner set a $2 million bond for Fuentes, who is being held in the Franklin County jail  (Columbus Dispatch). Spencer Brown: So, the horrific story that has been used nationally as a bludgeon against pro-life Americans as supposed proof that overturning Roe and returning decisions on abortion to the American people and their elected representatives was a preventable crime that could have been stopped if the suspect had been unable to illegally enter and/or remain inside the United States (Townhall).

Democrats Block Republican Efforts to Prevent Supreme Court Expansion

Daily Wire: House Democrats blocked a Republican request Wednesday that would have prevented the expansion of the Supreme Court. The Republican resolution proposed an amendment to the Constitution requiring the Supreme Court to be composed of nine justices — as it has been for the past 153 years, Rep. Tom Cole (R-OK) pointed out Wednesday. “Fundamentally changing the composition of the court to satisfy the demands of one political party would permanently erode the independence of the judicial branch and forever alter the separation of powers, which is the very foundation our constitution and our nation were built upon,” Cole warned. But Democrats blocked the resolution on Wednesday (Daily Wire). Congressman Kelly Armstrong: Progressives want to pack the Supreme Court to get their extreme wish list, while they focus on headlines and fundraising pleas. They know their radical policies are unpopular, so they seek to avoid responsibility and have unelected justices impose them (Twitter). House Rules Republicans: @HouseDemocrats just blocked @HouseGOP requests to uphold the 153-year-long composition of the Supreme Court, protect the balance of power & prevent the judicial branch from being subjected to political whims & wishes of one party (Twitter).

ADF Senior Counsel Erin Hawley Defends Crisis Pregnancy Centers From Attacks by Left Radicals

Katie Pavlich: Testifying in front of the House Oversight Committee Wednesday morning, Alliance Defending Freedom Senior Counsel Erin Hawley pushed back against false allegations and smears being hurled by the left against crisis pregnancy centers (Townhall). Greg Price: Warren: “Crisis pregnancy centers that are there to fool people looking for pregnancy termination help outnumber abortion clinics by 3-1. We need to shut them down all around the country” (Twitter). Mary Margaret Olohan: Erin Hawley, ADF senior counsel, addresses criticisms of pro-life pregnancy centers: “They are not fake centers. In 2019, they served 1.85 million families, provided $266 million worth of goods – of car seats, of baby formula, of diapers, of things that women really need” (Twitter). Alliance Defending Freedom: “An abortion is a situation in which a child is PURPOSEFULLY put to death . . . Neither miscarriages nor medical emergencies nor ectopic pregnancies involve that situation.” – ADF Senior Counsel Erin Hawley (Twitter).

Los Angeles Lawmakers Look to Remove Sheriff Villanueva Due to His Stance Against Progressive Policing

Fox News: The Los Angeles County Board of Supervisors on Monday directed its attorney to draft a proposed ballot measure to give the body the power to remove Sheriff Alex Villanueva following repeated clashes between both parties. The board voted 4-1, with Supervisor Kathryn Barger casting the lone dissenting vote. The matter would still need final passage from the board for it to be put in front of voters on Nov. 8. If passed, it would give the panel the power to remove an elected sheriff “for cause” with a four-fifths vote. In a Monday letter to the board, Villanueva blasted the proposal, calling it “recipe for corruption.” He further said it would allow “board members to intimidate sheriffs from carrying out their official duties to investigate crime” (Fox News). LA Country Sheriffs: SHERIFF VILLANUEVA’S RESPONSE TO AGENDA #12 (Twitter). Washington Examiner: Villanueva, who is a centrist Democrat, has battled the board over its “defund the police” stance, enabling a growing homeless population, and support of social welfare programs for criminals in lieu of jail time (Washington Examiner).

Sri Lanka’s President Fled Country Leaving Extremely Unpopular PM in Command

Associated Press: Sri Lanka’s president fled the country Wednesday, plunging a nation already reeling from economic chaos into more political turmoil. Protesters demanding a change in leadership then trained their ire on the prime minister and stormed his office. President Gotabaya Rajapaksa and his wife left aboard an air force plane bound for the Maldives, and he made his prime minister the acting president in his absence. That appeared to only further roil passions in the island nation, which has been gripped for months by an economic meltdown that has triggered severe shortages of food and fuel. Thousands of protesters who wanted Prime Minister Ranil Wickremesinghe to go had anticipated that he would be put in charge. They rallied outside his office compound, and some scaled the walls. The crowd roared its support for the people charging in and tossed water bottles to them (Associated Press). BBC: The president’s departure threatens a potential power vacuum in Sri Lanka, which needs a functioning government to help start digging it out of financial ruin. Politicians from other parties have been talking about forming a new unity government but there is no sign they are near agreement yet. It’s also not clear if the public would accept what they come up with. Under the constitution, it’s Mr Wickremesinghe who should act in the president’s stead if the latter resigns, but he is also deeply unpopular. That leaves the parliament’s speaker as the next most likely to step in as caretaker president, constitutional experts say. But Mahinda Yapa Abeywardena is an ally of the Rajapaksas, and it is unclear whether the public would accept his authority. Whoever does become acting president has 30 days to hold an election for a new president from among members of parliament. The winner of that vote could then see out the remainder of Mr Rajapaksa’s term until late 2024 (BBC).

Biden Claims Democrats Would Vote for Him When Multiple Polls Indicate He is Vastly Unpopular

New York Post: President Biden lashed out a reporter who asked what he would say to Democrats who don’t want him to run for a second term Tuesday — insisting that the party is behind him despite a recent survey showing nearly two-thirds of its voters want a different nominee in 2024. “They want me to run,” Biden, 79, said during the White House Congressional Picnic. “Read the poll. Read the polls, Jack. You guys are all the same. That poll showed that 92% of Democrats, if I ran, would vote for me” (New York Post). Recent polling shows 64 percent of Democrats prefer a new Democrat candidate (New York Times). Pew Research: Among the overall public, 37% say they approve of Biden’s job performance, while 62% disapprove. More than twice as many adults strongly disapprove of Biden’s job performance as strongly approve (45% vs. 18%) (Twitter).

Virginia Governor Glenn Youngkin Declares State of Emergency Following Flash Floods Leaving 40 People Missing

Daily Wire: Virginia Governor Glenn Youngkin declared a state of emergency on Wednesday in the wake of a devastating flood in Buchan County that damaged or destroyed more than 100 homes and left approximately 40 people missing. Youngkin declared a state of emergency for first responders to assist residents impacted by the heavy rainfall and severe flooding, which began hitting the Southwest region on Tuesday night (Daily Wire). Governor Youngkin: A state of emergency allows the Commonwealth to mobilize resources and deploy people and equipment to assist in response and recovery efforts. The declaration also allows officials from Virginia to coordinate the provision of resources with our state and local partners. This action does not apply to individuals or private businesses (Virginia.gov).
