John, BREAKING: We have just released a declaration for Secretaries of State to sign, barring Donald Trump from appearing on their state ballots as a presidential candidate under Section 3 of the Fourteenth Amendment. Trump’s incitement of the January 6th insurrection is the exact situation for which Section 3 was enacted. This violent, seditious attack on the United States Capitol, in an effort to stop the certification of the electoral votes from the 2020 election, was a grave threat to our democracy and violated the oath of office Trump took to protect and uphold the Constitution. As of today, Trump and his insurrectionist allies have not been held accountable for their crimes. Section 3 of the 14th Amendment makes clear that anyone who takes an oath of office and then engages in insurrection is forever disqualified from holding public office again. Our just-released declaration, a detailed explanation for why Donald Trump is constitutionally barred from appearing as a candidate on future ballots, includes citations to case law affirming the role state election officials have in determining a candidate’s constitutional eligibility, relevant facts of the events leading up to and including the insurrection on January 6, and legal analysis of the definition of “insurrection” and “engage.” Secretaries of State have a duty to ensure that candidates who seek to appear on their state ballots meet the constitutional qualifications for serving in public office.
