The Wyoming Department of Environmental Quality (WDEQ) has received a request from Biota Research and Consulting, Inc. on behalf of Teton County Public Works for State certification of U.S. Army Corps of Engineers (USACE) Nationwide Permit #14, for discharge of dredged or fill material to Fish Creek in Wilson, Wyoming. The purpose of the project is construct a pathway bridge across Fish Creek adjacent to the State Highway 22 bridge for purposes of connecting downtown Wilson with the Stilson/Snake River area. Much of the activity will occur above the ordinary high-water mark, though temporary impacts to approximately 0.034 acre of wetland are expected. All surface waters within the Fish Creek drainage are designated Class 1 where point source discharges are prohibited except for storm water and construction related discharges. This certification will require meeting the provisions in Chapter 1, Section 7(b) of the WDEQ Water Quality Rules and Regulations, which allows these discharges under certain circumstances.
