Next year, the U.S. Supreme Court is going to decide Moore v. Harper, a case that could have huge consequences for election law and voting. That’s because the case gives the Court the opportunity to review the independent state legislature theory (ISL), a fringe, right-wing theory that could allow state legislatures to set election rules and congressional maps unchecked — not by governors, the courts, the people or even state constitutions themselves. Democracy is literally going to be on the docket.
