From sweeping Supreme Court decisions to the deadliest migrant-smuggling tragedy in our nation’s history due to President Biden’s open-border crisis, much has happened since our last Telegram.
We will touch on that and more later in this week’s edition, but first, I want to get into a very important Supreme Court ruling that was made last week limiting the Environmental Protection Agency (EPA) gross overreach.
For years, unelected bureaucrats at the EPA have been enacting sweeping “green fantasy” regulations with little regard for the livelihoods, jobs, and communities these rulings impact.
They have made it their goal to destroy reliable energy sources, heeding the calls of then-presidential candidate Barak Obama to “bankrupt” coal companies.
As far back as 2008, Joe Biden declared that there will be, "No coal plants here in America."
But thanks to the Supreme Court’s latest ruling, the days of unelected bureaucrats ruling over the American people with an iron fist are over.
Last week, the Supreme Court ruled in West Virginia v. EPA that the EPA does not have the heavy-handed authority to regulate CO2 emissions without permission from Congress.
This decision restores checks and balances, restricts the power of the radical environmental lobby, and most importantly, returns power back to the American people through their elected representatives.
With much of the West already experiencing blackouts and Wisconsin power companies warning of potential rolling blackouts for the first time ever, this ruling represents an important victory for American families and a defeat for the new “Liberal World Order” – as Far Left activists are now calling their extreme agenda.
The American people now get to decide if they want affordability and reliability or rolling blackouts (more on that later).

Taxing your constitutional rights?
You’ve probably heard President Biden’s repeated lectures about how “No amendment to the Constitution is absolute” as he defends his efforts to chip away at the rights of law-abiding gun owners. And even though the U.S. Supreme Court recently stepped in to defend the Second Amendment, it didn’t take long for House Democrats to come up with another end-run scheme: If they can’t legislatively strip away our Second Amendment rights they’ll do what they do best – tax it. Their proposal, which was introduced by 37 House Democrats and currently has one fifth of their caucus listed as cosponsors, will create a whopping 1000% excise tax on firearms. Meaning that firearms which typically cost between $500 to $2,000 would carry a $5,000 to $20,000 tax. Two other lawmakers, Rep. Hank Johnson (GA-04) and Sen. Elizabeth Warren (MA) proposed plans to “triple the existing tax on handguns to 30% and nearly quintuple the current tax rate on shells and cartridges to 50%.” Because these proposals are tax hikes, they could potentially sail through Congress under a procedure known as “reconciliation,” and sidestep the Senate’s filibuster rule. Weaponizing taxation as a way of pricing Americans out of their constitutional rights isn’t just wrong, its tyrannical. As I’ve said before I will always defend our constitutional rights and push back against government encroachment, which is why I signed on to Rep. Andrew Clyde’s (GA-09) RETURN our Constitutional Rights Act. This bill would eliminate the federal excise tax on firearms and ammunition because you shouldn’t have to pay-to-play for constitutional rights. It’s important to note that this tax revenue has always gone to a good cause (it funds wildlife restoration and conservation), so this bill ensures those vital programs will remain funded – without compromising our rights.
Stopping the illegal alien invasion
It is no secret that President Biden has completely lost control of America’s border. Since shutting down construction of the border fence last year and returning to the failed policy of releasing huge numbers of migrants into American communities, we’ve seen monthly illegal immigration records repeatedly shattered. This week the Biden administration took another step toward totally erasing our southern border by announcing that it will simply ignore a longstanding immigration law that prevents migrants who choose to stay in the US illegally from reapplying to re-enter our country for up to 10 years. The situation on the U.S.-Mexico border has gotten so bad that several Texas counties took the unprecedented step of declaring the tidal wave of migrants flooding across the border as an invasion, and have prepared to take matters into their own hands. But they shouldn’t have to. That’s why this week I filed an amendment to an annual Defense Department bill that would authorize the training and deployment of US military personnel to our border to stop terrorists, drug smugglers, human traffickers and illegal aliens from slipping into the United States. The consequences of Biden’s botched border policy
Last week, 53 illegal aliens were found dead inside a sweltering tractor-trailer in San Antonio, Texas. While this human smuggling tragedy is heartbreaking, it is unfortunately a predictable byproduct of President Biden’s open-border policies. By bringing back the failed Obama-era policy of “catch-and-release,” and making repeated promises of amnesty, President Biden has laid out the welcome mat for illegal immigrants, and created a lucrative new incentive for drug smugglers and human traffickers. So it’s no surprise that migrant deaths have hit record totals or that cartels are raking in record profits. It is a lethal combination that has turned our federal government into the biggest human trafficking syndicate on earth. Yet in the face of grim discoveries like the one in San Antonio and the worsening immigration crisis, President Biden’s Secretary of Homeland Security Alejandro Mayorkas recently claimed that the administration has “operational control” of America’s southern border. It is time for President Biden to start taking responsibility for the humanitarian catastrophe he has created and stop ignoring our immigration laws.

Selective enforcement on full display
This week a bodega clerk in New York City who killed a would-be assailant in self-defense found himself behind bars. For exercising his right to self-defense, he was locked up in Rikers Island on $250,000 bail. His treatment stands in stark contrast to the career criminals who are often granted “no-cash-bail” and are sometimes back on the streets within hours. Just as President Biden has chosen to selectively enforce our immigration laws, many Big City, “progressive” District Attorneys continue to employ the same approach. Prosecutors are supposed to stand up for the rights of law-abiding citizens and punish the criminals – not the other way around. That’s why I introduced the Prosecutors Need to Prosecute Act, which would require prosecutors to report how often they follow through on holding criminals charged with murder, rape, arson, crimes involving illegal guns, and motor vehicle theft, accountable. It would also mandate disclosures regarding how often prosecutors secure convictions, whether those charged were already on probation or parole, and how many offenders were released without bail.
Keeping the lights on
We can all be thankful for the abundant natural resources that fuel America’s economy. Dependable, affordable sources of power like nuclear, coal and natural gas make up the backbone of our nation’s electrical generation system. These sources – unlike intermittent, inefficient, and often heavily subsidized “green” energy systems like Made-in-China solar panels and windmills – don’t depend on the sun shining, the wind blowing, or forced labor to keep our lights on. Unfortunately, some politicians seem intent on changing that, and the consequences could be dire. We’ve already seen the impacts of this kind of mismanagement in California and New York, but last month saw warnings about the possibility of such outages right here in Wisconsin. The reason? “[G]rowing demand for power, and the retirement of coal-powered plants,” according to one recent news report. Fortunately, two utilities have announced they will temporarily delay the planned retirement of some existing coal plants – but this isn’t good enough. We need to keep all of our traditional power plants up and running. Wisconsinites should never face the prospect of Third World-style rolling blackouts. Our state’s families, farmers, factories, small businesses, and hospitals need low-cost electricity they can depend on 24 hours a day, 365 days a year – not market distorting government mandates and taxpayer subsidies that could leave us all in the dark.

Foreigners voting in American elections?
I know it sounds crazy – but that’s exactly what some politicians are calling for. Earlier this year, that effort kicked into high-gear when New York City joined a number of other U.S. cities in allowing people who are not U.S. citizens to vote. President Biden’s Department of Justice, in an effort to accelerate this dangerous trend, is actually trying to block state efforts to require proof of citizenship before people can cast ballots. This makes no sense. American elections should be decided by American citizens – period. That’s why I joined my colleague Rep. Gary Palmer (AL-06) in introducing the Citizen Ballot Protection Act. This bill would help safeguard the integrity of our elections by explicitly empowering states to verify the U.S. citizenship of voters when they register. You can read more about our bill here.
Hometown heroes
Last week, alongside the entire Wisconsin delegation, I introduced two bills to rename two local post offices after three American heroes. These bills pay tribute to Captain Robert C. Harmon and Private John R. Peirson, and Corporal Mitchell Red Cloud Jr. Captain Harmon was serving his 51st mission when he was shot down over France shortly before the D-Day invasion in Europe. A year later, Private Peirson was killed during an Easter Day assault in Okinawa, Japan. Corporal Mitchell Red Cloud Jr. was a Medal of Honor recipient who served in the Marines and Army in World War II and Korea (you can read more about him here). These two bills recognize the legacy and patriotism of these three Wisconsin veterans, and are a small but important token of our gratitude for their service to our country.
District Update
Wausau pilot honored with federal award
I want to congratulate Gilbert Lloyd Buettner from Wausau on his latest achievement of receiving the Wright Brother’s Master Pilot Award from the Federal Aviation Administration (FAA). Mr. Buettner served in the Vietnam War as a pilot in the Air Force and is known as the guy around town to fly with and learn from. The Wright Brothers Master Pilot Award is presented to pilots who have practiced safe flight operations continuously for 50 or more years. In fact, less than 150 pilots in Wisconsin hold this distinguished honor. Congratulations, Mr. Buettner! Thank you for your service and thank you for your dedication to safe flying.
Local businesses hit hard by inflation
A recent study found that 60% of small businesses are feeling more pain from Biden’s inflation than the COVID lockdowns – something I hear from many local business owners around Wisconsin’s Seventh District. This week, I stopped by Miller's Market in Hayward. While there, I ran into the owner who shared his concerns on how rising prices are crippling his small business and making it harder for him to create jobs. He’s not alone. Main Street businesses across America are struggling under the weight of government spending-fueled inflation. The good news is that there are things we can do to tame inflation. First, Congress must stop the excessive spending. Second, we must unleash American energy production, and lastly, we must address government polices that discourage people from going back to work.

The USDA continues to make resources and assistance available to agricultural producers and working families to ensure access, safety and stability for food markets and supplies.
Small businesses can also apply for assistance through the Economic Injury and Disaster Loan program. This program provides economic relief to businesses that are currently experiencing a temporary loss of revenue as a result of the pandemic.
