Last week the Supreme Court agreed to hear a case that could upend election law around the country by giving partisan state legislatures sole control over deciding winners and losers of elections, without any checks and balances. Until recently, this “independent state legislature” theory was a fringe idea - basically an argument that legislatures can float above governors and state courts to do whatever they want with elections. Now, the Supreme Court could possibly make that theory the law of the land.
This could have massive negative consequences - and could further politicize our election outcomes.
My job as Secretary of State is to ensure that our elections are fair, accurate, honest, and secure. My role is to be impartial and non-partisan; a safeguard against the further politicization of our elections - so that our democracy remains intact.
That could all become much harder to do if the Supreme Court goes the wrong way in this new case. Having Secretaries of State who administer fair and impartial elections is more critical than ever.
