6 Republicans on the Supreme Court just took up a case for next year that
represents a ticking time-bomb under our democracy. This case could give
Republican-controlled state legislatures the power to overrule voters in
2024 in exactly the way they tried -- but failed -- to do in 2020.
The Washington Post reports that the Republicans on this Court could use
the case to "give state lawmakers free rein to change [election] rules to
favor their own party...making it easier for a legislature to disregard
the will of its state’s citizens."
Sen. Elizabeth Warren said last week this Supreme Court "has burned
whatever legitimacy they may still have had... they just took the last of
it and set a torch to it." Now, by taking this case at this time, they
have increased the urgency of getting Congress and the White House to act.

Supreme Court is increasingly facing a legitimacy crisis. Congress must
consider Court reforms aimed at restoring the American people's trust and
confidence in the Supreme Court."
The Washington Post continues: "Immense power would go to legislative
bodies that are themselves undemocratic, many advocates say, because they
have been gerrymandered to create partisan districts, virtually ensuring
the party-in-power’s candidates cannot be beaten. Republicans control both
legislative chambers in 30 states and have been at the forefront of
pushing the theory."
Senator Sheldon Whitehouse (D-RI) tells the Post: "This phony 'doctrine'
is an anti-democratic Republican power grab masquerading as legal theory.
It was cooked up in a right-wing legal hothouse by political operatives
looking to give state legislatures the power to overturn the will of
American voters in future elections."
Trump's 1st Supreme Court nominee -- Justice Gorsuch -- has already
written in favor of the theory advanced by this case, writing in a 2020
opinion, "The Constitution provides that state legislatures -- not federal
judges, not state judges, not state governors, not other state officials
-- bear primary responsibility for setting election rules.”
Ending abortion rights, slashing the federal government's ability to fight
climate change, taking the teeth out of Miranda-rights, overturning gun
laws, and putting crosshairs on gay marriage and contraception was just
this Court's opening salvo -- the air war that precedes their ultimate
annihilation of our democracy.
Time is now running out on convincing Congress and the White House to act
on reforming the Court.
