John, The Supreme Court is meant to serve as one of America’s sole nonpartisan bodies, adherent to the Constitution and its principles over all else. Yet the Court now faces a crisis of legitimacy at the hands of justices like Clarence Thomas, who has repeatedly ruled in cases involving conflicts of interest. Last month, we learned that Ginni Thomas, Justice Thomas’ wife, urged 29 Arizona lawmakers to overthrow the will of the voters and install pro-Trump electors following the November 2020 presidential election. She also sent numerous text messages to former Trump Chief of Staff Mark Meadows in an attempt to disregard the results of the election and keep Trump in power. Yet Justice Thomas refused to recuse himself in cases that Trump and his allies brought to the Supreme Court which falsely argued, as Ginni Thomas has argued, that there was massive voter fraud in the election and that the Supreme Court should overturn the election results. Further, Justice Thomas even refused to recuse himself in the Supreme Court case addressing the right of the House Select Committee to access Trump White House records to conduct its investigation of the insurrection on January 6, 2021. Justice Thomas was the lone dissenter in that case, arguing that the committee should be blocked from accessing those records. All of this has created a crisis of legitimacy for the US Supreme Court. If Justice Thomas used his position on the US Supreme Court to protect and advance his own personal interests, that would constitute an abuse of power and an impeachable offense. This is hardly the first time Clarence Thomas has failed to recuse himself when he faced obvious conflicts of interest. In 2000, he joined the majority in Bush v. Gore, handing the presidency to George W. Bush while his wife was actively aiding Bush’s transition team. In 2012, he participated in the first challenge to the Affordable Care Act even though his wife was being paid to lobby against it and to seek its repeal. And in 2017, he ruled to uphold Trump’s cruel Muslim ban while Ginni Thomas received funding from one of the organizations that urged the court to uphold it. By remaining on the Supreme Court and continuing to rule in cases that clearly involve conflicts of interests, Justice Thomas represents a dangerous threat to the Court’s legitimacy as a neutral entity.
