How do we fix the Supreme Court?

The Supreme Court has used its recent term to restrict women's rights, make our communities less safe, and set back policies to protect our environment.

Just in the last month, the court has:

-Gutted states’ ability to implement common-sense gun reforms
-Blurred the line of separation between church and state
-Overturned Roe v. Wade and let states implement harsh abortion bans that leave zero exception for life of the mother, rape, or incest
-Severely limited the EPA's ability to regulate greenhouse gasses that cause climate change

And it's only going to get worse from here on out. The decision to overturn Roe v. Wade, for example, has the potential to uproot other issues concerning the constitutional right to privacy — such as same-sex marriage, access to contraceptives, or any number of rights that we hold dear. And in the next term, we could see this court further dismantle the Voting Rights Act.

To mitigate the immediate damage from this court's recent rulings, LBR is focused right now on solutions in Congress – including legislation that codifies the right to an abortion. But we also have to fundamentally re-evaluate how the Supreme Court operates in relation to our legislature. When an unelected group of extreme judges can undo decades of precedent and uproot people's fundamental rights — in clear defiance of the popular will — something needs to change.

It’s important to remember how we got here. This court's current right-wing majority owes itself to dirty tricks and unprecedented actions by Republicans that defied American voters.

In 2016, Mitch McConnell held up the nomination of Merrick Garland for nearly one year, all to deny President Obama the pick on the court that he deserved. And just mere days before the 2020 election, Donald Trump rushed to appoint Amy Coney Barrett to replace the late Ruth Bader Ginsburg. Quite frankly, it's an insult to the foundations of our country that a third of this court was appointed by a President who routinely broke the law and tried to instigate a coup.
