Happy JURY Independence Day!

Dear John,

As we celebrate Independence Day in the United States, let us remember that it is about JURY INDEPENDENCE right up there on the list with other kinds of independence.

The Declaration of Independence tells the story. See if you can detect it in this excerpt:

Englishmen in the American colonies often broke laws as a means to resist government violations of their rights. Their neighbors, serving on their juries, were apt to exercise jury nullification to protect them from imprisonment and other punishment.

To get around this inconvenient "benefit" of trial by jury, secure convictions, and get those rebelling out of the way, the English government began "transporting [them] beyond seas" where they were tried without sympathetic juries to protect them. These were among the grievances that the American Revolution was fought to resist.

Trial by jury, complete with jurors' right to conscientiously decline to enforce the law, is (to quote from a recent SCOTUS decision) "deeply rooted in the Nation’s history and tradition" and is "an essential component of “ordered liberty.”"

How do we know this? It is right there in the Declaration of Independence.

Just a few years shy of the 250th anniversary of this revolutionary declaration, our very own government is once again inflicting upon us the very same kinds of "injuries and usurpations" that led the colonists to revolt.

Will you fight to preserve the benefits of trial by jury that the founders went to war to secure for future generations?

I am challenging you to create a fully informed jury this month by introducing 12 people who are not already familiar with jury nullification to their full authority when serving on a jury. An easy way to do this is to share with them one or both of our go-to shortcut links.
