A coalition of environmental groups is suing the Biden administration for failing to consider the harm endangered species face from oil and gas emissions from drilling on public lands.
The lawsuit argues the administration is ignoring the Endangered Species Act when issuing drilling permits. The suit claims oil burned from a well drilled in one place adds to the pollution in the atmosphere. That, in turn, heats the planet and devastates endangered species like coral reefs in Florida, Arctic polar bears, and monk seals in Hawaiʻi.
This is a novel legal theory, but one based in commonsense. If the environmental coalitions are successful, an estimated 3,500 permits issued during the Biden administration could be revoked — and future permitting would become far more complex.
Unsurprisingly, Big Oil and Gas are fighting back.
Industry officials claim the lawsuit is a backdoor effort to curb fuel development, leading to harm to the economy. They argue that, for every drilling permit issued, the federal government carries out environmental analyses — and environmental opponents have the opportunity to challenge decisions.
