Rep Clyde Introduces RETURN our Constitutional Rights Act

Last week I introduced my RETURN (Repealing Excise Tax on Unalienable Rights Now) our Constitutional Rights Act, with 56 original co-sponsors, which would revoke the excise tax on firearms, ammunition, bows and arrows. My reasoning behind introducing this bill is that a right that can be taxed is no right at all. Moreover, if the government can tax a right just a little bit, it can tax it a lot. As the Supreme Court’s 2008 Heller decision upheld, the right to bear arms is an individual right and taxing it infringes on the ability of the individual to exercise that right.

That is exactly what is happening right now in Congress. Liberal lawmakers are purposefully pushing legislation that would make firearms unaffordable for the average American. Just two weeks ago, Representative Don Beyer (D-VA) introduced legislation to impose a 1000 percent excise tax on any type of semi-automatic firearm. Under this draconian arrangement, Americans would encounter a $5,000 tax on a $500 gun, and a $200 tax on a $20 magazine. This obviously purposefully oppressive bill would make firearms prohibitively expensive and act as a soft ban on firearms ownership.

I introduced my signature bill to repeal the excise tax on firearms to protect law abiding Americans simply exercising their Constitutional right to keep and bear arms. Though, these excise taxes from firearms sales currently provide funding to states through a program known as Pittman-Robertson that directs spending toward firearms and hunting safety training courses and for wildlife conservation, my bill will fully maintain these programs as they currently exist with an alternate and more consistent funding stream. The funding comes from the lease revenue of federal lands used for oil and gas exploration and will allow states to engage in more consistent budgetary planning for these programs independent of the ebbs and flows of firearm sales in any given year.

I am honored to represent the interests of Georgia’s 9^th District and this bill delivers on the first promise I made when I first ran, to introduce legislation to repeal the excise tax on firearms.

Rep. Clyde Opposes House Gun Bill

For weeks, Democrats, and disappointingly even a few of my Republican colleagues, have been fixated on disarming our nation by weaponizing national tragedies in order to advance illogical, ineffective, and illegal gun-grabbing legislative proposals. Yet instead of standing strong in the fight to protect Americans’ Second Amendment rights, Democrats and Republicans in both chambers have woefully abandoned these enumerated rights by passing a reckless gun control bill that clearly infringes on American’s Constitutional rights. I’m deeply disappointed in these lawmakers for choosing political convenience over the preservation of our Constitution, as this bill strips law-abiding Americans of their Second, Fourth, Fifth, and Fourteenth Amendment liberties.

Beyond the massive expansion of Medicaid and the $100 million handout for FBI salaries buried in the bill, this legislation bans military service-age adults from fully exercising their constitutional rights until the age of 21. Furthermore, this severely-misguided measure institutes so-called ‘red flag laws,’ which strip citizens of their due process rights by allowing the government to confiscate their property—without any crime committed or rightful day in court. Subsequently, that individual will be left to hire a lawyer at their own expense in order to prove their innocence and to have their property returned.

While the results of this legislation will not take some of the guns from all of the people, it will take all of the guns from some of the people—threatening the safety of families, communities, and businesses across the country. Make no mistake, this bill is not a compromise; it is gun control, plain and simple. Regrettably, I believe this is just the first step in anti-Second Amendment lawmakers’ plan to achieve their utopia of an unarmed America—a world in which our precious liberties are demolished and our Republic as we know it is dismantled. I continue to stand against their Big Government Socialist gun control agenda and I refuse to waiver in my defense of Americans’ unalienable right to keep and bear arms.

Week Ahead

After three weeks of partisan battle in Washington, I sure am glad to be back in Georgia’s beautiful Ninth District! This week I’ll be meeting with local businesses and organizations to learn more about their operations and to discuss how I can help them through my work in Congress.

As we look forward to our Independence Day this July 4^th, let us remember the beauty of the American Republic, the sacrifices of countless veterans and the hard-working Americans who have made this nation the greatest on Earth. On the Fourth of July, I will be celebrating with my friends and family to commemorate the glorious founding of our nation and how blessed we are to live here. I encourage everyone to take a little time this weekend to reread the Declaration of Independence, the birth certificate of our nation. God Bless these United States of America!
