The Supreme Court has sided with the coal industry and its state allies by ruling against the Environmental Protection Agency (EPA).

With a 6 to 3 ruling, our nation’s highest court has constrained EPA’s authority to address climate pollution from existing coal-fired power plants under the Clean Air Act..

The ruling recognizes EPA’s authority and responsibility to address climate pollution under the Clean Air Act including EPA’s responsibility to limit climate pollution from new fossil fuel power plants, cars and trucks, oil and gas development, and industrial sites.

We must be ready to fight even harder in the courts, in Congress, in state legislatures and at the ballot box. And to do that we need everyone to raise their voice.

This case is a clear warning that coal companies and their allies will not back down in their fight to constrain the federal government’s authority to address climate change, regardless of the will of the American people or the branches of government accountable to them.

While the Supreme Court recognized EPA's authority to address pollution from existing fossil fuel power plants under the Clean Air Act, it constrains EPA’s authority to rely on clean energy solutions the power industry itself identified as the most common, proven and cost-effective.

Scientists warn that time is running out to stop the climate crisis and we need every tool in the toolbox to stop the forthcoming onslaught of climate disasters. While today’s ruling takes away some of the most common and cost-effective tools, it’s essential we continue pushing harder for climate action at every level.
