Supreme Court Rules That Biden Administration Can End MPP

WASHINGTON, D.C. — Today the Supreme Court ruled that the Biden administration can lawfully end the so-called Migrant Protection Protocols (MPP), also known as "Remain in Mexico."  

Although the ruling means that the Biden administration can terminate MPP, states could potentially challenge the termination on procedural grounds in lower courts. 

The policy, which the Trump administration implemented in 2019, has forced more than 70,000 migrants to wait for the duration of their immigration proceedings in Mexico — and often in danger.  

"Though the ruling leaves open the possibility of procedural challenges in lower courts, today’s decision is a positive step," said Dan Gordon, Vice President of Strategic Communications at the National Immigration Forum. "The so-called Migrant Protection Protocols have always put human beings in danger and run counter to due process.  

"MPP is not part of the orderly, secure, and humane border policy we need. Congress and the Biden administration must work together to process arrivals effectively and efficiently, treat migrants with dignity, and address the root causes of migration."
