Public Charge Legal Updates
We at PIF are happy to announce another litigation win for public charge. On Monday, the U.S. Court of Appeals for the Seventh Circuit (which sits in Chicago) rejected a bid by Texas Attorney General Ken Paxton to intervene in litigation that ended in 2020, with an order striking down the Trump public charge policy. This is the second courtroom victory for immigrant families this month. On June 15, the U.S. Supreme Court rejected a similar petition by Arizona’s attorney general, who sought to intervene in a California case. PIF partners were actively involved in both lawsuits, and we applaud their leadership and thank them for their vigorous defense of immigrant families.
These decisions leave public charge policy unchanged. The 1999 Immigration and Naturalization Service guidance remains in effect, as it has been since March 2021, when the Biden Administration ended the Trump public charge policy. The Biden DHS announced its intent to finalize new public charge regulations as early as July.
