Representative Adriano Espaillat Introduces the Protect Veteran Students, Job Seekers, and Entrepreneurs Housing Act

Espaillat Bill Amends the Servicemembers Civil Relief Act To Provide Greater Protections for Veterans and their Families

NEW YORK, NY – This month, Representative Adriano Espaillat (NY-13) introduced the Protect Veteran Students, Job Seekers, and Entrepreneurs Housing Act to preserve and provide greater protections for Veterans and their families.

“Currently, residential properties and landlords do not guarantee that educational assistance and benefits provided to veterans through the Department of Veterans Affairs will be accepted as income to help residential leases,” said Rep. Espaillat. “This limitation affects many veterans and their families across my district in their ability to access quality and affordable housing. Our veterans served our nation, and upon their return home, we have a responsibility to ensure benefits and resources that will help them transition back to civilian life following their service—and my bill aims to do just that.”

The Protect Veteran Students, Job Seekers, and Entrepreneurs Housing Act (H.R. 7885) proposes a series of amendments to the Servicemembers Civil Relief Act and would require landlords to consider certain educational assistance administered by the Secretary of Veteran Affairs as income as well as require a residential lease period to not exceed the number of months an individual is entitled to educational assistance in order to preserve housing for veterans and their families.

Current statute allows for the VA to eliminate or pause veteran benefits if they miss a requirement, even if it is due to circumstances out of a veteran’s control, such as a death or other major life events. Additionally, the Espaillat bill would establish a 60-day grace period before the VA is permitted to terminate educational assistance benefits when an individual does not fulfill a program requirement.

“These past years have shown us that personal circumstances can change in an instant. We must ensure that servicemembers, veterans, and their families are not immediately cut off from receiving educational assistance or job training benefits and instead are provided an opportunity to remedy program requirement to ensure these benefits remain in place,” Espaillat concluded.

Congresista Adriano Espaillat introduce la Ley de Vivienda para Proteger a Estudiantes, Solicitantes de Empleo y Emprendedores Veteranos

Proyecto de ley de Espaillat modifica la Ley de Ayuda Civil para Miembros del Servicio a fin de brindar mayor protección a los veteranos y sus familias

NEW YORK, NY – Este mes, el congresista Adriano Espaillat (NY-13) introdujo la Ley de Vivienda para Proteger a los Estudiantes, los Solicitantes de Empleo y los Emprendedores Veteranos, a fin de resguardar y brindar mayor protección a los veteranos y sus familias.

“Actualmente, las propiedades residenciales y los caseros no garantizan que la asistencia educativa y los beneficios proporcionados a los veteranos a través del Departamento de Asuntos de Veteranos se aceptarán como ingresos para ayudar con los alquileres de viviendas residenciales”, dijo el Rep. Espaillat. “Esta limitación afecta a muchos veteranos y sus familias en mi distrito en su capacidad para acceder a viviendas asequibles y de calidad. Nuestros veteranos sirvieron a nuestra nación y, al regresar a casa, tenemos la responsabilidad de garantizar los beneficios y los recursos que los ayudarán a hacer la transición de regreso a la vida civil después de su servicio ―y mi proyecto de ley tiene como objetivo hacer precisamente eso”.

La Ley de Vivienda para Proteger a los Estudiantes, los Solicitantes de Empleo y los Emprendedores Veteranos (H.R. 7885) propone una serie de enmiendas a la Ley de Ayuda Civil para Miembros del Servicio y requeriría que los caseros consideren cierta asistencia educativa administrada por el Secretario de Asuntos de Veteranos como ingresos, así como también exigir una período de alquiler de vivienda residencial que no exceda la cantidad de meses a la que una persona tiene derecho a asistencia educativa, para de este modo preservar la vivienda para los veteranos y sus familias.

El estatuto actual permite que el VA elimine o suspenda los beneficios para veteranos si ellos no cumplen con un requisito, incluso si se debe a circunstancias fuera del control del veterano, como una muerte u otros eventos importantes de la vida. Además, el proyecto de ley de Espaillat establecería un período de gracia de 60 días antes de que se le permita al VA cancelar los beneficios de asistencia educativa cuando una persona no cumple con un requisito del programa.

“Estos últimos años nos han demostrado que las circunstancias personales pueden cambiar en un instante. Debemos asegurarnos de que los miembros del servicio, los veteranos y sus familias no se vean inmediatamente privados de recibir asistencia educativa o beneficios de capacitación laboral y, en cambio, se les brinde la oportunidad de remediar su falta en los requisitos del programa para garantizar que estos beneficios permanezcan vigentes”, concluyó Espaillat.
