The final decision in Dobbs v. Jackson Women’s Health Organization is out, and as expected after a draft opinion leaked in May, it overturns Roe v. Wade . This is a day that we knew was coming, yet it is still shocking for those of us who stand for reproductive rights.

As a lawyer who specializes in feminist legal theory, I am appalled. For the last 50 years, the law of the land has been that the Constitution protects access to abortion as part of the fundamental right to privacy. Friday’s opinion removes that protection and declares that the right to privacy does not include abortion. This puts abortion rights in the hands of state legislatures and Congress, and many of those states have already acted to ban abortion within their borders. And although the decision speaks only to abortion, it weakens the right to privacy that protects other rights such as access to contraceptives and marriage equality for LGBTQ+ people.
This means that the fight for reproductive rights has changed significantly overnight, from federal courts to state legislatures, state courts, and Congress.
